The Managing Authority is responsible for the implementation of the Programme. Some of the tasks of the Managing Authority may be delegated to the Intermediate Bodies and to the Implementing Bodies.The scope of responsibilities, tasks and competencies is defined in relevant agreements/agreements concluded between these institutions.

 

Managing Authority

The Managing Authority - the minister in charge of regional development - is responsible for the management of the European Funds for Infrastructure, Climate, Environment 2021-2027 Programme. The minister's services within the scope of his function are provided by the Department of Infrastructural Programmes within the structures of the Ministry of Development Funds and Regional Policy. The Managing Authority is responsible for the efficient and due implementation of the programme – both in the overall approach and at the level of individual projects. In addition, it issues recommendations and manuals on various aspects related to the implementation of the programme and conducts promotional and information activities.

The competences of the Managing Authority are very broad – from the development of the programme itself, through the selection of projects for co-financing, commissioning payments to beneficiaries and verification of the correctness of their expenditures, to comprehensive monitoring of the progress of the programme implementation and verification of the objectives achieved.

The tasks of the Programme Managing Authority are regulated by the Act on the Rules for the Implementation of Tasks Financed from European Funds in the Financial Perspective 2021-2027 (the so-called Implementation Act).

Tasks of the Programme Managing Authority

  • development of the content of the programme documents;
  • issuing recommendations and manuals;
  • establishing a management and control system;
  • approval of the Intermediate Body's implementing instructions and issuing recommendations for it;
  • preparation of templates of applications for co-financing, co-financing agreements;
  • preparation of criteria for the selection of projects for co-financing;
  • preparation of a project evaluation and selection system;
  • implementation of the expense accounting process;
  • control of the implementation of the operational programme, including verification of the correctness of expenditure incurred by beneficiaries;
  • examining appeals against decisions on the return of funds issued in the first instance by the intermediate or implementing body;
  • considering, pursuant to Article 66(2) of the Implementation Act, protests in relation to competitions conducted by Intermediate Bodies in the transport, culture and health sector;
  • evaluation of the operational programme;
  • monitoring the progress of the implementation of the operational programme;
  • reporting to the European Commission, among others on the progress in implementing the programme;
  • providing information about the operational program and its promotion, conducting educational activities.

Intermediate Bodies

The Programme Managing Authority may delegate the performance of some of its tasks to the Intermediate Bodies, at the same time delegating responsibility for their implementation. However, the Managing Authority remains responsible for the implementation of the entire programme.

The scope of duties of the Intermediate Body is defined by an agreement with the Managing Authority. These are tasks related to the implementation of the part of the programme in which the institution specialises.

In the case of the European Funds for Infrastructure, Climate, Environment 2021-2027 Programme, the function of the Intermediate Body is performed by:

  • Centre for EU Transport Projects for the following priorities: Priority III Urban transport, Priority IV Support for the transport sector from the Cohesion Fund, Priority V Support for the transport sector from the ERDF; VIII Technical Support;
  • Ministry of Climate and Environment for the following priorities: Priority I Support for the energy and environment sectors from the Cohesion Fund, Priority II Support for the energy and environment sectors from the ERDF; VIII Technical Support;
  • Ministry of Health for Priority VI Health;
  • Ministry of Culture and National Heritage for Priority VII Culture.

Tasks

  • management of the particular priorities of the programme;
  • selection of projects, concluding grant agreements with beneficiaries and deciding on project funding;
  • verifying that the expenditure declared by the beneficiaries has actually been incurred and in a correct manner;
  • settlement of co-financing agreements with beneficiaries;
  • providing the Managing Authority with all information necessary for the implementation of the expenditure accounting process to the European Commission;
  • monitoring the implementation of project co-financing agreements, including indicators;
  • control of ongoing projects;
  • preparation of reports for the Managing Authority on the implementation of the tasks entrusted to it;
  • evaluation of particular priorities;
  • recovery of amounts  subject to refund, including the issuance of administrative decisions in this respect;
  • consideration of protests in relation to competitions conducted by Implementing Authorities in the environment and energy sector;
  • conducting informational, promotional and educational activities.

Implementing Authority

The Intermediate Body, with the consent of the Managing Authority, may delegate to the Implementing Authority tasks in the field of direct handling of the granting of support or control of the implementation of projects. The function of the Implementing Authority may be performed, for example, by units subordinate to ministries or agencies for the development of entrepreneurship or regional development.
